1 General provisions relating to these terms and conditions of sale (hereafter, the CGVs)

1.1. Object of the CGV

The CGVs are applicable exclusively to the online sale of Domaine de Rocheville's products on the website,the site, which is free and free of charge to any Internet user.

1.2. CGV application area

The CGVs exclusively govern the online sales contracts of Domaine de Rocheville's products to buyers with consumer quality (hereafter, consumers) and constitute with the purchase order the contractual documents applicable to the parties, excluding any other documents, prospectuses, catalogues or photographs of products that have only an indicative value.

THE CGVs are exclusively applicable to products delivered to consumers established in metropolitan France.

1.3. Availability and opposability of CGVs

The CGVs are made available to consumers on the domaine de Rocheville website via the hyperlink "general terms of sale" link, where they are directly searchable; they can also be communicated to them by simple request by phone, email or mail.
THE CGVs are enforceable to the consumer who acknowledges, by checking a box provided for this purpose, having been aware of them and having accepted them before ordering.
The validation of the order by its confirmation is worth the purchaser's approval to the CGVs in force on the day of the order, which are maintained and reproduced by Domaine de Rocheville in accordance with Article 1369-4 of the Civil Code.

1.4. Changes to GVCs

Domaine de Rocheville reserves the right to modify its CGVs at any time.
If the GVCs are changed, these changes are enforceable from the time they are put online and cannot apply to previous contracts. The applicable GVCs are those in effect on the date of the order.

1.5. CGV Clauses

The nullity of a contractual clause does not result in the nullity of the GMCs, unless it is an impulsive and decisive clause that has led one of the parties to enter into the sale contract.
The temporary or permanent non-application of one or more CGV clauses by Domaine de Rocheville does not apply to the waiver of the other clauses of the CGVs that continue to produce their effects.

2 Protection of minors

By entering the site's home screen, the consumer commits to being 18 years old by the date of the order.

3 Products

3.1. Features

The products offered for sale presented in the catalogue published on the site are each the subject of a description available on the website of the company Domaine de Rocheville by clicking on each product; this description mentions the essential characteristics of the product within the meaning of section L. 111-1 of the Consumer Code.
Photographs illustrating the products are not a contractual document, especially labels, counter-labels and bottle style (excluding their capacity) can vary without warning.

3.2. Compliance

The products comply with the requirements of current French law relating to the safety and health of persons, the loyalty of commercial transactions and the protection of consumers at the time of their introduction on the market.

4 Prices

4.1. Sale price

The selling price of the product is the one in effect on the day of the order, and taking into account the VAT applicable on the day of the order.
The sale prices, in accordance with Article L. 113-13 of the Consumer Code, are indicated, for each of the products in the electronic catalogue, in euros all taxes included, excluding delivery and transport costs.
The delivery and transportation costs will be reported to consumers prior to the validation of the order and will be charged extra.
In the event of a promotion, Domaine de Rocheville undertakes to apply the promotional price to any order placed during the promotion.
The total amount owed by the consumer is shown on the order confirmation page.

4.2. Change

Domaine de Rocheville reserves the right to change its prices at any time, while guaranteeing the consumer the application of the price in effect on the day of the order.

5 Duration of offer

Online offers presented on the site are valid, in the absence of any indication of a specific duration, as long as the products appear in the electronic catalogue and within the limit of available stocks.

6 Order

6.1. Contract Closing Steps

To place an order, the consumer, after filling out his virtual shopping cart by indicating the selected products and the desired quantities, then clicks the "Order" button and provides the information about the delivery and payment method.
Before clicking the "Confirm order"button, consumers can check the details of their order and their total price and return to the previous pages to correct any errors or possibly change their order.
Confirmation of the order leads to acceptance of the CGVs and forms the contract.
After confirming the contents of his order, the consumer will definitively validate it by payment. The order will only be final after the corresponding price is paid.
An email acknowledging receipt of the order and payment is sent by Domaine de Rocheville as soon as possible.

6.2. Changing control

Any change of order by the consumer after confirmation of his order is subject to the acceptance of the company Domaine de Rocheville.
Domaine de Rocheville reserves the right to make changes to the ordered product that are related to technical development under the conditions of Article R. 132-2-1, V of the Consumer Code.

6.3. Validation of the order

Domaine de Rocheville reserves the right to refuse any order for legitimate reasons and, in particular, if the quantities of products ordered are abnormally high for buyers of consumer quality.

6.4. Unavailability of ordered products

If the products ordered are unavailable for delivery, Domaine de Rocheville immediately informs the consumer and can offer a product of equivalent quality and price.
In case of disagreement, the consumer is reimbursed no later than thirty days of payment of the sums paid.

6.5. Archive and evidence

The archiving of communications, purchase orders and invoices is carried out on reliable and sustainable support in such a way as a faithful and lasting copy in accordance with Article 1348 of the Civil Code.
These communications, purchase orders and invoices can be produced as proof of the contract.

7 Payment

7.1 Available Wines

The products ordered are payable in full on order and in euros.
An invoice expressed in Euros TTC will be issued by Domaine de Rocheville and sent to the customer at the billing address indicated.
In the event of non-payment or refusal of payment authorization by accredited organizations, Domaine de Rocheville reserves the right to refuse an order.

7.2 Payment terms

Payment is made immediately by ordering by credit card or cheque sent to the address of the head office as mentioned in Article 1, cash mandate or transfer.

7.3. Securing payment

Payment by credit card is made via the secure website called credit AGRICOLE e-transactions. This site is registered with 3D secure security (VISA SECURE).

8. Retraction

8.1 Available Wines

From the time the products are received, the consumer has a withdrawal period of fourteen free days to return the delivered products without having to justify themselves or to pay a penalty, to the address contained in Article 1.
The cost of return is the responsibility of the consumer.
To return the products, the consumer must first send an email to Domaine de Rocheville specifying the number of the cancelled order in order to obtain a return number.
Domaine de Rocheville undertakes to reimburse the consumer no later than 14 days after the date on which the right of withdrawal was exercised, provided that the returned products are in their original packaging, complete, in perfect condition and accompanied by the original purchase invoice.

9 Delivery

9.1 Delivery location

The products are delivered to the address indicated by the consumer on the purchase order, on a single site in metropolitan France.

9.2. Delivery time

Domaine de Rocheville undertakes to deliver the products within 15 days of receiving the order, and to pay the corresponding price.

9.3. Delayed delivery

The delay in delivery exceeding seven days and not due to a case of force majeure may result in the resolution of the sale by the consumer who, within sixty working days from the date of delivery indicated, will renounce its order by letter recommended with request for notice of receipt, return the products if they have been delivered if they have been delivered and will receive from Domaine de Rocheville within thirty days the return of its payment, excluding any compensation.

9.4. Delivery terms

Delivery is made by an independent carrier and the goods travel at the recipient's peril (Article 100 and 133-3 of the Code of Commerce) whether they are shipped in due port, prepaid port or french port.

Any delivery of an order is subject to the payment of any previous invoice.

9.5. Product compliance

If the product does not comply with the order, the consumer must file a claim with Domaine de Rocheville for the replacement of the product or possibly the resolution of the sale.

9.6. Failure to deliver

The total failure to deliver will result in the full resolution of the sales contract.

10 Guarantees

10.1. Legal guarantees

All products provided by the professional seller benefit from the legal guarantee of compliance under Articles L. 211-4 to L. 211-14 of the Consumer Code and the legal guarantee of hidden defects provided for in Articles 1641 to 1649 of the Civil Code.
Under these guarantees, the professional seller undertakes, at the consumer's choice, to reimburse him or to exchange the products defective or not corresponding to his order.

Article L211-4 French Consumer Code
The seller is required to deliver a contract-compliant property and responds to any compliance deficiencies that exist at the time of issuance. It also addresses compliance defects resulting from the packaging, assembly instructions or installation when it has been placed in its care by the contract or has been carried out under its responsibility.

Article L211-5 Consumer Code
To comply with the contract, the property must:

(1) - Be clean for the usually expected use of a similar property and, if necessary:
Match the seller's description and possess the qualities that the seller has presented to the buyer in the form of a sample or model
Present the qualities that a buyer can legitimately expect in light of public statements made by the seller, the producer or his representative, including in advertising or labelling

(2) - Or present the characteristics defined by the parties or be specific to any special use sought by the buyer, brought to the seller's knowledge and which the seller has accepted.

Article L211-12 Consumer Code
The action resulting from the non-compliance is prescribed by two years from the issuance of the property.

Article 1641 French Civil Code
The seller is bound by the guarantee because of the hidden defects of the thing sold which make it unsuitable for the purpose to which it is intended, or which diminish this use so much, that the buyer would not have acquired it, or would have given only a lower price, if he had known them.

Article 1648 paragraph 1st Civil Code
The action resulting from the defects must be brought by the purchaser within two years of the discovery of the defect.

10.2. Safeguards Act

The French law applicable to the contract under Article 16 of the CGV cannot have the effect of depriving the consumer residing in another Member State of the provisions on guarantees granted to him by his national law under Directive 99/44/EC of 25 May 1999 concerning the sale and guarantees of consumer goods.

11 Intellectual property

The elements reproduced on this site, whether visual or audio, are the exclusive property of the publisher, and are protected by copyright, trademark and patent law.
Any reproduction and dissemination of these elements, without prior written permission from the publisher, exposes offenders to legal action.

12 Personal data
